MEDIATION

Mediation is a structured process in which a neutral third party, called a mediator, helps two or more parties in a dispute attempt to reach a voluntary, mutually acceptable resolution. It is commonly used in civil legal matters. Unlike a judge or arbitrator, the mediator does not have the authority to make decisions for the parties; instead, the mediator facilitates communication and negotiation to help them find common ground and work towards a solution.

Key aspects of mediation include:

  1. Voluntary Resolution:  While the attendance at a mediation may be mandatory, and negotiating in good faith is always required, the resolution of your case via mediation is absolutely voluntary.  An impasse will be declared by the mediator if the parties do not reach an agreement.
  2. Confidential: Florida’s mediation laws and rules are very strict on this issue.  Any and all information shared during mediation is confidential. Experience has shown that confidentiality allows for more genuine negotiations among the parties. Any resolutions reached by the parties are often confidential as well.  A breach of this confidentiality can lead to very serious consequences for the offending party.
  3. Binding Resolution: Although the mediator cannot impose a solution, any agreement reached by the parties is typically binding. This allows the parties to have finality to their dispute once an agreement is reached.
  4. Collaborative: The mediator encourages collaboration rather than competition between the parties, promoting creative solutions that benefit everyone involved.

Mediation is often considered a cost-effective, quicker, and less formal alternative to litigation or arbitration.

During a mediation session, Jeff Vastola will facilitate discussions between the parties to help reach a mutually agreeable resolution. The process is designed to be efficient and effective, with a focus on addressing the core issues of the dispute and finding practical solutions.

 At Solutions Mediation, we offer:

  • We offer mediation for circuit civil cases, arbitration (binding and non-binding), and voluntary trial services throughout the State of Florida.
  • We charge $300 per hour, with a two-hour minimum and a $100 administrative fee.
  • We offer both Zoom mediations and arbitrations to accommodate parties who prefer or require remote sessions. This allows us to provide our services throughout the State of Florida, regardless of location.
